TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legally binding agreement between you and FALSEFLVG LLC, an Indiana limited liability company ("FALSEFLVG," "we," "us," or "our"), governing your access to and use of falseflvg.com, its subdomains, webpages, features, content, and related online properties operated by or on behalf of FALSEFLVG (collectively, the "Site"), and your purchase, receipt, access to, or use of any Products or Services offered by FALSEFLVG.

Please read these Terms carefully before accessing the Site, creating an account, submitting information, placing an order, or using any FALSEFLVG Product or Service.

IMPORTANT: THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, INDEMNIFICATION OBLIGATIONS, AND AN AGREEMENT TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT. THEY ALSO INCLUDE A CLASS ACTION WAIVER AND, WHERE PERMITTED BY LAW, A JURY TRIAL WAIVER. PLEASE READ THESE TERMS CAREFULLY.

By accessing or using the Site, creating an account, placing an order, submitting content, clicking a button or checkbox indicating acceptance, or otherwise purchasing or using Products or Services where these Terms are presented or linked, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Site or purchase Products or Services from FALSEFLVG.

1. SCOPE OF THESE TERMS

These Terms apply to all present and future Products and Services offered, sold, licensed, distributed, made available, or otherwise provided by FALSEFLVG unless a specific Product, Service, promotion, transaction, or program is expressly governed by separate written terms.

For purposes of these Terms:

"Products" includes physical goods offered by FALSEFLVG now or in the future, including dietary supplements, drink mixes, apparel, accessories, merchandise, promotional products, and other consumer goods.

"Digital Materials" includes guides, research materials, downloadable files, educational materials, reports, videos, protocols, reference materials, ebooks, electronic documents, or other digital content.

"Services" includes Digital Materials, educational materials, website features, communications, programs, promotions, or other services made available by FALSEFLVG.

These Terms are intended to apply to FALSEFLVG as a brand and business and are not limited to NEWBRAIN or any single Product.

If additional terms are presented with a particular Product, Service, promotion, contest, giveaway, offer, or transaction, those additional terms will also apply.

If specific terms directly conflict with these general Terms, the more specific terms will control solely with respect to that particular Product, Service, promotion, or transaction.

FALSEFLVG Parties

For purposes of these Terms, "FALSEFLVG Parties" means FALSEFLVG LLC and its past, present, and future members, owners, managers, officers, employees, contractors, consultants, agents, representatives, affiliates, parent companies, subsidiaries, successors, assigns, licensors, licensees, service providers, manufacturers, distributors, fulfillment providers, advertising partners, marketing partners, technology providers, and other persons or entities acting for, through, under the authority of, or on behalf of FALSEFLVG.

Unless otherwise expressly stated, references in these Terms to protections, releases, disclaimers, limitations, defenses, licenses, indemnification rights, or other rights granted to FALSEFLVG are intended to include the FALSEFLVG Parties where applicable.

Nothing in these Terms gives a contractor, consultant, manufacturer, service provider, advertising partner, marketing partner, or other FALSEFLVG Party an independent right to use customer information or customer content for its own unrelated purposes.

Any rights granted to such parties under these Terms must be exercised in connection with FALSEFLVG's business or activities authorized by FALSEFLVG.

2. ELIGIBILITY AND PERSONAL USE

You must be at least eighteen (18) years old and legally capable of entering into a binding contract to purchase Products, create an account, or otherwise transact with FALSEFLVG.

By using the Site or placing an order, you represent that you satisfy those requirements.

Products intended for adults must not be purchased for or supplied to children.

Unless FALSEFLVG expressly authorizes otherwise in writing, Products are sold for personal, lawful use and not for unauthorized commercial resale, redistribution, diversion, or export.

FALSEFLVG may establish purchase limits by Product, customer, address, household, payment method, promotion, or other reasonable criteria.

We may investigate, limit, refuse, suspend, or cancel orders that we reasonably believe involve:

  • fraud;

  • unauthorized resale;

  • false information;

  • stolen or unauthorized payment methods;

  • circumvention of purchase limits;

  • abuse of promotional offers;

  • abuse of the 365-Day First-Purchase Guarantee;

  • misuse of FALSEFLVG intellectual property; or

  • other unlawful, deceptive, abusive, or harmful conduct.

3. DIETARY SUPPLEMENTS, HEALTH INFORMATION, AND MEDICAL DISCLAIMER

FALSEFLVG may sell dietary supplements, including NEWBRAIN, and may offer other health, wellness, educational, or consumer Products now or in the future.

Dietary supplements are not drugs and are not intended to replace medical care.

Where required by applicable law, dietary-supplement labeling carries the following disclaimer:

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Nothing provided by FALSEFLVG or any FALSEFLVG Party through:

  • the Site;

  • Product pages;

  • Product packaging;

  • Product labels;

  • Digital Materials;

  • research guides;

  • emails;

  • text messages;

  • social-media content;

  • advertisements;

  • videos;

  • articles;

  • customer-service communications;

  • educational materials;

  • promotional materials; or

  • any other communication

is intended to constitute medical advice, diagnosis, treatment, prescription, or individualized healthcare advice.

Information provided by FALSEFLVG is for general informational and educational purposes only.

No Product, dietary supplement, guide, Digital Material, article, research summary, protocol, communication, or other material offered by FALSEFLVG is intended to replace advice, diagnosis, or treatment from a physician or other qualified healthcare professional.

You should consult an appropriately qualified healthcare professional before using a dietary supplement if you:

  • are pregnant or nursing;

  • take prescription medication;

  • take over-the-counter medication;

  • have a diagnosed medical condition;

  • have known allergies or sensitivities;

  • are scheduled for surgery;

  • are under medical supervision; or

  • otherwise have concerns regarding whether a Product is appropriate for you.

Follow the directions, serving information, and warnings appearing on the actual Product label.

Do not exceed the labeled serving or recommended use.

Discontinue use and seek appropriate medical attention if you experience an adverse reaction.

Seek immediate emergency medical attention where appropriate.

Keep Products intended for adults out of reach of children.

Individual Results

Individual experiences and results vary.

No:

  • testimonial;

  • review;

  • customer statement;

  • study summary;

  • research discussion;

  • Product description;

  • advertisement;

  • social-media post; or

  • other communication

constitutes a promise or guarantee that you will experience the same result or any particular result.

A satisfaction guarantee offered by FALSEFLVG is a contractual refund policy only.

It is not a guarantee that a Product will produce a particular physiological, cognitive, emotional, health, athletic, performance, or other result.

Research and Third-Party Studies

FALSEFLVG may provide links to, discussions of, citations to, or summaries of scientific research concerning individual ingredients, compounds, Products, practices, or other subjects.

Research involving an individual ingredient does not necessarily establish that a finished FALSEFLVG Product will produce the same results observed in a particular study.

Research outcomes may depend upon factors including:

  • study population;

  • ingredient source;

  • dosage;

  • frequency;

  • duration;

  • formulation;

  • study design;

  • methods;

  • participant characteristics; and

  • other variables.

Studies and research are provided for transparency and educational purposes.

They are not individualized medical advice.

4. PRODUCT INFORMATION, LABELS, FORMULATIONS, AND WEBSITE CONTENT

FALSEFLVG makes reasonable efforts to describe Products accurately.

However, Product descriptions, photographs, renders, graphics, packaging, colors, ingredient information, serving information, Product specifications, availability, pricing, promotional information, and other Site content may occasionally contain errors, inaccuracies, or outdated information.

To the fullest extent permitted by applicable law, Product:

  • packaging;

  • suppliers;

  • manufacturing sources;

  • ingredient sources;

  • formulation;

  • appearance;

  • artwork; or

  • labeling

may change without prior notice.

For ingestible Products, the label physically accompanying the Product you receive controls regarding ingredients, serving size, directions, warnings, allergen information, and other label-specific information.

You are responsible for reading the Product label before use.

FALSEFLVG reserves the right, subject to applicable law, to:

  • correct errors;

  • correct omissions;

  • update Site content;

  • change prices;

  • alter packaging;

  • modify Products;

  • modify formulations;

  • change vendors or suppliers;

  • discontinue Products;

  • limit available quantities;

  • establish purchase limits;

  • modify promotions; or

  • withdraw an offer before acceptance.

5. ORDERS, ORDER ACCEPTANCE, PRICING, TAXES, AND PAYMENT

Orders

Submitting an order constitutes an offer by you to purchase the Products identified in the order.

FALSEFLVG reserves the right to accept or reject any order.

Receipt of an automated order acknowledgment or confirmation does not prevent FALSEFLVG from cancelling an order before shipment where permitted by law.

Reasons for cancellation may include:

  • suspected fraud;

  • unauthorized payment;

  • inventory errors;

  • pricing errors;

  • Product description errors;

  • technical errors;

  • purchase-limit violations;

  • suspected resale;

  • promotion abuse;

  • guarantee abuse; or

  • other legitimate business reasons.

If FALSEFLVG cancels an order after collecting payment and does not provide the purchased merchandise, the applicable amount will be refunded as required by law.

Pricing

Prices are displayed in U.S. dollars unless expressly stated otherwise.

Prices may change before an order is submitted.

Subject to correction of errors as permitted by law, the applicable price is generally the price shown at checkout when the order is placed.

Taxes

Applicable sales, use, excise, or similar taxes may be collected based on the transaction, Products purchased, and shipping destination.

Payment Authorization

By submitting a payment method, you represent that:

  • you are authorized to use it;

  • the information you provide is accurate; and

  • you authorize FALSEFLVG and its payment processors to charge the total presented at checkout.

The total may include:

  • Product charges;

  • taxes;

  • shipping;

  • and other charges clearly disclosed before payment.

Payment processing may be performed by independent third parties.

Those third parties may operate under their own terms, privacy practices, and security systems.

FALSEFLVG does not necessarily independently collect, store, or control all payment information processed by those providers.

6. ONE-TIME SUPPLY OPTIONS, BUNDLES, PROMOTIONS, FREE SHIPPING, AND FREE GIFTS

No Current Subscription or Automatic Renewal

FALSEFLVG does not currently sell NEWBRAIN on a subscription, continuity, recurring-payment, or automatic-renewal basis.

Descriptions such as:

  • 30-Day Supply;

  • 60-Day Supply; or

  • 90-Day Supply

describe the approximate amount of Product contained in the purchase based upon its intended serving schedule.

They do not constitute a subscription.

They do not authorize automatic future shipments.

They do not authorize recurring billing.

They do not create an ongoing purchase commitment.

For NEWBRAIN, unless otherwise stated on the applicable Product page:

  • a 30-Day Supply means one (1) tub;

  • a 60-Day Supply means two (2) tubs; and

  • a 90-Day Supply means three (3) tubs.

If FALSEFLVG offers a subscription or automatic-renewal program in the future, it will be separately identified and subject to additional disclosures, consent procedures, cancellation rights, and terms required by applicable law.

Free Shipping

A 90-Day Supply of NEWBRAIN currently qualifies for free standard shipping where that offer is expressly presented.

Other Products, order values, bundles, promotions, or geographic destinations may qualify for free shipping when expressly stated.

Free shipping:

  • has no cash value;

  • cannot be separately redeemed;

  • may be limited by destination;

  • may be limited by shipping method; and

  • applies only where expressly offered.

Discounts and Promotions

Discounts, coupon codes, launch pricing, promotional pricing, bundle offers, and other incentives are governed by the terms displayed with the applicable offer.

Unless otherwise stated, promotions:

  • cannot be combined;

  • have no cash value;

  • may be Product-specific;

  • may be limited by customer or household;

  • may be subject to inventory availability;

  • may be modified before purchase;

  • may be ended before purchase; and

  • may not be transferred.

FALSEFLVG may cancel an order involving fraudulent, unauthorized, or abusive use of a promotion.

Free Gifts and Limited-Edition Promotional Items

Certain orders may qualify for free promotional gifts based on:

  • purchase quantity;

  • order value;

  • bundle selection;

  • launch promotion;

  • promotional threshold; or

  • another qualifying condition.

Promotional gifts may include limited-edition merchandise such as a Burn the Script hat.

MEETING A PURCHASE THRESHOLD OR OTHER QUALIFYING CONDITION DOES NOT GUARANTEE THAT A FREE GIFT WILL BE AVAILABLE.

Unless expressly stated otherwise, all promotional gifts are:

  • available only while supplies last;

  • subject to available inventory;

  • limited in quantity;

  • not guaranteed merely because an order qualifies;

  • not redeemable for cash;

  • not separately refundable;

  • not separately transferable for store credit;

  • not separately exchangeable;

  • not guaranteed in a particular style, size, color, or variation unless expressly stated; and

  • deemed to have no cash value for refund purposes.

FALSEFLVG may substitute another promotional item where the applicable promotion allows substitution.

FALSEFLVG has no obligation to substitute an unavailable promotional gift unless required by law.

If promotional inventory is exhausted, an otherwise qualifying order may ship without the gift.

Except where applicable law requires otherwise, the exhaustion, absence, or unavailability of a free promotional gift does not:

  • reduce the purchase price of the Products;

  • create a right to a partial refund;

  • create a right to cash compensation; or

  • create a right to store credit.

7. SHIPPING, DELIVERY, DELAYS, AND ADDRESS ACCURACY

Available shipping methods, charges, and estimated delivery information may be displayed at checkout or elsewhere on the Site.

Shipping and delivery dates are estimates unless expressly guaranteed in writing.

You are responsible for providing a complete, correct, and deliverable shipping address.

FALSEFLVG is not responsible for delays, additional costs, or non-delivery caused by inaccurate or incomplete information supplied by you, except where applicable law provides otherwise.

Orders may begin processing shortly after they are submitted.

FALSEFLVG may be unable to change or cancel an order after processing has begun.

If you request an order change or cancellation, we will make reasonable efforts to accommodate the request but cannot guarantee that a change can be made.

Delivery may be affected by circumstances outside our reasonable control, including:

  • carrier delays;

  • weather;

  • natural disasters;

  • labor interruptions;

  • governmental action;

  • transportation disruptions;

  • supply-chain interruptions; or

  • other events beyond our reasonable control.

If FALSEFLVG cannot ship within a timeframe required by applicable law, we will provide any cancellation option, consent request, notice, or refund required by law.

Title and risk of loss pass as provided by applicable law.

Nothing in these Terms eliminates shipping, non-delivery, damage, or consumer rights that cannot lawfully be waived.

Lost, Damaged, Incorrect, or Missing Orders

Inspect your order promptly after delivery.

If purchased merchandise:

  • arrives materially damaged;

  • contains the wrong Product; or

  • is missing

Include your order number and any information reasonably requested to investigate the issue.

FALSEFLVG may request:

  • photographs;

  • packaging information;

  • tracking information;

  • carrier information; or

  • other reasonable documentation.

Where appropriate, FALSEFLVG may provide a:

  • replacement;

  • refund;

  • credit; or

  • other lawful remedy.

Fraudulent or abusive delivery claims may result in denial, order restrictions, account restrictions, cancellation of future orders, or other lawful action.

8. 365-DAY FIRST-PURCHASE GUARANTEE

FALSEFLVG currently offers a 365-Day First-Purchase Guarantee on NEWBRAIN purchased directly from FALSEFLVG through falseflvg.com.

The guarantee may apply to additional Products in the future only when the applicable Product page, offer, or checkout expressly states that the Product is covered.

A Product expressly covered by the guarantee is referred to in this Section as a "Covered Product."

The existence of the guarantee for NEWBRAIN does not automatically extend the guarantee to:

  • apparel;

  • hats;

  • accessories;

  • merchandise;

  • Digital Materials;

  • guides;

  • services;

  • promotional gifts;

  • bonus items; or

  • future Products.

A. First Qualifying Purchase Only

The guarantee applies only to your first qualifying purchase of a Covered Product directly from FALSEFLVG.

Second and later purchases are not eligible.

Attempting to create a new qualifying purchase by:

  • using a different email address;

  • creating another account;

  • changing payment methods;

  • using another customer name;

  • ordering through another household member; or

  • otherwise circumventing the guarantee

does not create a new guarantee.

B. One Guarantee Per Household

The guarantee is limited to one qualifying guarantee claim per household.

For purposes of this policy, a household generally means persons residing at the same residential address.

If multiple persons in the same household place qualifying orders, only one qualifying first-purchase guarantee may be used by that household.

FALSEFLVG may use order information reasonably available to us to identify duplicate, fraudulent, or abusive claims.

C. 365-Day Claim Period

A guarantee request must be received by FALSEFLVG within 365 calendar days of the date the qualifying first order was placed.

Requests received after the 365-day period are not eligible under the guarantee.

D. Maximum NEWBRAIN Refund: Three Tubs / 90-Day Supply

For NEWBRAIN, the guarantee covers no more than:

three (3) tubs, equivalent to a 90-Day Supply, per qualifying first purchase and per household.

Purchasing more than three tubs in your first order does not increase the maximum guarantee.

Any quantity exceeding three tubs is not eligible for refund under the 365-Day First-Purchase Guarantee.

E. Amount Refunded

For an eligible claim, FALSEFLVG refunds the amount actually paid for the eligible Covered Product after applicable discounts, subject to the maximum limits stated in this Section.

If a first NEWBRAIN order contains more than three tubs, the refundable Product amount will be calculated using the effective discounted per-unit price actually paid in that order and will be limited to no more than three tubs.

Purchasing four, five, six, or more tubs on a first order therefore does not make the entire order eligible for refund.

Applicable taxes attributable to refunded merchandise will be treated as required by law.

F. Shipping Charges Are Not Refunded

Original shipping charges paid by the customer are not refundable under this satisfaction guarantee.

If the original qualifying order received free shipping, there is no shipping charge to refund.

This provision does not limit any shipping refund independently required by law for a cancelled, unshipped, damaged, missing, or otherwise legally defective transaction.

G. Free Gifts and Bonus Items

Any:

  • promotional gift;

  • Burn the Script hat;

  • free merchandise;

  • bonus item;

  • sticker;

  • decal;

  • Digital Material;

  • promotional insert; or

  • other item provided without separate charge

has no cash value for purposes of the guarantee.

Such items:

  • do not increase the refund amount;

  • are not separately refundable; and

  • do not reduce an otherwise valid refund for eligible Covered Products.

H. No Return Required Unless Requested

Unless FALSEFLVG specifically instructs you otherwise, you are not required to return opened or used Covered Product to use the guarantee.

FALSEFLVG may request a return where reasonably appropriate and legally permissible.

Returned ingestible Products should not be assumed eligible for resale.

I. How to Request the Guarantee

Email:

from the email address associated with your order whenever reasonably possible.

Include:

  • your name;

  • your order number; and

  • a clear statement that you are requesting the 365-Day First-Purchase Guarantee.

FALSEFLVG may ask reasonable questions or request reasonable information necessary to:

  • verify the order;

  • confirm eligibility;

  • prevent duplicate claims; or

  • investigate suspected fraud.

We may request feedback concerning your Product experience because it helps improve our Products and business.

An otherwise valid refund will not depend on providing a positive review, testimonial, or particular explanation.

J. Refund Method

Approved refunds will generally be issued to the original payment method.

The time required for a refund to appear may depend upon your bank, card issuer, or payment provider.

K. Fraud and Abuse

The guarantee is intended for legitimate first-time customers.

To the fullest extent permitted by law, FALSEFLVG may deny a guarantee request where we reasonably determine that the request involves fraud or abuse, including:

  • duplicate claims;

  • multiple claims by one household;

  • false identities;

  • manipulated order information;

  • resale;

  • bulk-purchase exploitation;

  • chargeback abuse;

  • payment fraud; or

  • circumvention of the three-tub maximum.

FALSEFLVG may also refuse future purchases from persons who abuse the guarantee.

L. Satisfaction Guarantee Only

The 365-Day First-Purchase Guarantee is a voluntary satisfaction-refund policy.

It is not a medical guarantee.

It is not an efficacy guarantee.

It is not a warranty that a Product will produce any particular health, cognitive, physiological, emotional, physical, athletic, or performance result.

The guarantee does not modify the disclaimers, warranty limitations, or liability limitations contained elsewhere in these Terms.

9. OTHER RETURNS, CANCELLATIONS, AND REFUNDS

The 365-Day First-Purchase Guarantee is separate from rights involving:

  • orders cancelled before shipment;

  • merchandise FALSEFLVG is unable to ship;

  • materially damaged merchandise;

  • incorrect merchandise;

  • missing purchased merchandise; or

  • other rights that cannot lawfully be waived.

Unless a Product page, separate written Return Policy, or applicable law states otherwise, FALSEFLVG does not promise a general right to return properly delivered Products simply because a customer changes their mind.

For health, hygiene, safety, and quality-control reasons, opened ingestible Products cannot be restocked or resold by FALSEFLVG.

Returned ingestible Products may be destroyed or discarded.

Refunds required for cancelled or unshipped merchandise are separate from a customer's use of the 365-Day First-Purchase Guarantee.

10. CUSTOMER ACCOUNTS AND ACCOUNT SECURITY

The Site may permit you to create a customer account.

If you create an account, you agree to:

  • provide accurate information;

  • keep login information confidential;

  • promptly update information that becomes inaccurate; and

  • notify FALSEFLVG if you reasonably believe unauthorized access has occurred.

You are responsible for activity conducted through your account to the extent permitted by law.

FALSEFLVG may suspend, restrict, or terminate an account where we reasonably believe the account is associated with:

  • fraud;

  • guarantee abuse;

  • promotional abuse;

  • unauthorized access;

  • prohibited conduct;

  • unauthorized resale; or

  • violation of these Terms.

11. DIGITAL MATERIALS, GUIDES, AND EDUCATIONAL CONTENT

FALSEFLVG may provide free or paid Digital Materials.

Unless expressly stated otherwise, Digital Materials are licensed to you for personal, noncommercial use and are not sold as intellectual property.

You may not, without prior written authorization from FALSEFLVG:

  • reproduce Digital Materials for commercial purposes;

  • resell them;

  • sublicense them;

  • publicly distribute them;

  • upload them to file-sharing systems;

  • publicly publish copies;

  • remove proprietary notices;

  • create competing commercial materials from them; or

  • otherwise commercially exploit them.

Educational and research materials remain subject to the health, research, warranty, and other disclaimers contained in these Terms.

12. REVIEWS, TESTIMONIALS, USER CONTENT, PHOTOS, VIDEOS, AND MARKETING RIGHTS

FALSEFLVG welcomes customer reviews, testimonials, feedback, photographs, videos, comments, social-media posts, messages, stories, and other content relating to FALSEFLVG, its Products, or its Services.

For purposes of this Section, "Your Content" means content that you voluntarily submit, provide, send, upload, tag, mention, or otherwise intentionally make available to FALSEFLVG in connection with FALSEFLVG's business, Products, Services, promotions, community, or marketing.

Your Content may include:

  • Product reviews;

  • testimonials;

  • ratings;

  • photographs;

  • videos;

  • written feedback;

  • survey responses;

  • contest submissions;

  • promotional submissions;

  • comments;

  • social-media posts;

  • social-media stories;

  • captions;

  • public posts tagging or mentioning an official FALSEFLVG account;

  • content submitted using a FALSEFLVG hashtag where the surrounding circumstances reasonably indicate an intent for FALSEFLVG to see, share, or engage with the content;

  • direct messages sent to an official FALSEFLVG account for the purpose of sharing feedback, a Product experience, testimonial, photograph, or video;

  • emails sent to FALSEFLVG for the purpose of sharing feedback, a Product experience, testimonial, photograph, or video; and

  • other content expressly submitted to FALSEFLVG for publication, promotional consideration, marketing, or sharing.

You Retain Ownership

You retain any copyright or other ownership rights you otherwise possess in Your Content.

Nothing in these Terms transfers ownership of Your Content to FALSEFLVG.

License Granted to FALSEFLVG

By voluntarily submitting or making Your Content available to FALSEFLVG as described above, you grant FALSEFLVG and the FALSEFLVG Parties, solely in connection with FALSEFLVG's business, Products, Services, marketing, advertising, promotion, public relations, customer communications, and other authorized business activities, a nonexclusive, worldwide, perpetual, irrevocable to the extent permitted by law, transferable, sublicensable, fully paid-up, and royalty-free license to:

  • use;

  • reproduce;

  • copy;

  • publish;

  • display;

  • distribute;

  • transmit;

  • repost;

  • otherwise use Your Content in any media or format now known or later developed.

No royalty, residual, license fee, usage fee, or other compensation will be owed to you by FALSEFLVG or any FALSEFLVG Party for uses authorized under this Section unless FALSEFLVG separately agrees otherwise in writing.

Name, Handle, and Attribution

Where you voluntarily submit or publish Your Content using your:

  • name;

  • profile name;

  • username;

  • social-media handle; or

  • other public identifier

you grant FALSEFLVG and the FALSEFLVG Parties permission to identify or attribute Your Content using that information in connection with an authorized use.

FALSEFLVG may also choose to use Your Content without attribution.

Photographs, Videos, Image, and Likeness

If Your Content contains your photograph, image, likeness, appearance, or other identifying visual material, you grant FALSEFLVG and the FALSEFLVG Parties permission to use that material as part of Your Content for the purposes authorized by this Section, subject to applicable law.

You represent that you have the right to submit any photograph, image, or video you provide.

If another identifiable person appears prominently in content you submit, you represent that you have obtained any permission reasonably necessary to submit that content for the uses described in these Terms.

Editing and Context

FALSEFLVG and the FALSEFLVG Parties may edit Your Content for:

  • length;

  • formatting;

  • spelling;

  • grammar;

  • cropping;

  • resizing;

  • presentation; or

  • placement.

FALSEFLVG will not knowingly edit a testimonial or review in a way that materially misrepresents the substance of the opinion or experience originally expressed.

FALSEFLVG has no obligation to publish or use Your Content.

Advertising and Endorsement Compliance

Permission to use Your Content does not require FALSEFLVG to publish statements that FALSEFLVG believes would violate:

  • advertising law;

  • dietary-supplement regulations;

  • endorsement rules;

  • consumer-protection laws;

  • intellectual-property laws; or

  • other applicable requirements.

FALSEFLVG may:

  • omit;

  • edit;

  • decline to publish;

  • discontinue; or

  • remove

content or statements that FALSEFLVG determines should not be used in advertising or marketing.

The fact that a customer makes a statement about a Product does not mean FALSEFLVG adopts that statement or is legally permitted to repeat it.

Honest Reviews and Opinions

Your Content should reflect your genuine experience, belief, or opinion.

Nothing in these Terms prohibits or restricts you from submitting or publishing an honest review, including an honest negative review, or otherwise expressing truthful opinions about FALSEFLVG or its Products.

FALSEFLVG does not require positive reviews as a condition of:

  • customer service;

  • a lawful refund;

  • guarantee eligibility;

  • promotional benefits; or

  • other rights.

Where you received:

  • money;

  • free Product;

  • a discount;

  • a free gift;

  • affiliate compensation; or

  • another material benefit

in connection with content about FALSEFLVG, any disclosure required by applicable law remains applicable.

FALSEFLVG may add, preserve, or clarify such disclosure where appropriate.

Public Content Directed to FALSEFLVG

If you publicly post content relating to FALSEFLVG or a FALSEFLVG Product and deliberately:

  • tag FALSEFLVG;

  • mention an official FALSEFLVG account;

  • direct the content to an official FALSEFLVG account;

  • submit the content through a FALSEFLVG feature; or

  • otherwise intentionally present the content to FALSEFLVG for engagement, sharing, or promotional consideration

you grant FALSEFLVG and the FALSEFLVG Parties the license described in this Section, subject to applicable law.

Merely discussing FALSEFLVG publicly without tagging, submitting, sending, or otherwise directing the content to FALSEFLVG does not, by itself, transfer ownership or automatically grant FALSEFLVG unlimited rights to that content.

Private Customer Communications

Routine private communications with FALSEFLVG, including ordinary:

  • customer-service emails;

  • support tickets;

  • private text messages;

  • private direct messages; or

  • telephone conversations

do not automatically become public testimonials or advertisements merely because they were communicated to FALSEFLVG.

If a private communication clearly contains material voluntarily submitted for:

  • testimonial use;

  • review;

  • publication;

  • marketing;

  • promotional consideration; or

  • sharing

the license in this Section applies to that submitted material.

FALSEFLVG may separately request permission before publicly using other private communications.

Voice and Recorded Communications

Nothing in these Terms gives FALSEFLVG blanket authorization to record private telephone calls or private conversations contrary to applicable law.

Where FALSEFLVG requests to record or use your:

  • voice;

  • audio;

  • interview;

  • recorded testimonial; or

  • telephone testimonial

for public, promotional, or advertising purposes, any additional consent required by applicable law will be obtained.

Withdrawal Requests

Because promotional materials may already have been:

  • produced;

  • distributed;

  • printed;

  • published;

  • licensed;

  • reposted;

  • archived; or

  • incorporated into completed campaigns

permission granted under this Section may not always be capable of retroactive withdrawal.

to request that FALSEFLVG discontinue future use of particular Your Content.

Where reasonably practicable and legally required, FALSEFLVG will honor such requests for future uses.

Removal may not be possible from:

  • previously printed materials;

  • completed advertisements;

  • archived materials;

  • third-party reposts;

  • already distributed materials; or

  • materials already produced before the request.

Your Representations

By submitting Your Content, you represent that:

  1. you created it or otherwise possess the legal right to submit it;

  2. submission and authorized use will not knowingly infringe another person's copyright, trademark, privacy, publicity, or other legal rights;

  3. where presented as a testimonial or review, it reflects your genuine experience or opinion; and

  4. you are at least eighteen (18) years old.

FALSEFLVG may reject, remove, or decline to use Your Content at any time.

13. INTELLECTUAL PROPERTY

The Site and its original content may include:

  • FALSEFLVG branding;

  • logos;

  • trademarks;

  • Product names;

  • slogans;

  • taglines;

  • Product designs;

  • packaging;

  • label artwork;

  • photographs;

  • renders;

  • graphics;

  • illustrations;

  • videos;

  • audio;

  • written copy;

  • advertising materials;

  • Digital Materials;

  • research guides;

  • website design;

  • original educational materials; and

  • other proprietary materials.

Such materials may be owned by, licensed to, created for, commissioned by, or lawfully used by FALSEFLVG or the applicable FALSEFLVG Party and may be protected by copyright, trademark, trade-dress, contract, or other intellectual-property laws.

For purposes of this Section, "FALSEFLVG Content" includes materials owned by, licensed to, created for, commissioned by, or lawfully used by FALSEFLVG or the FALSEFLVG Parties in connection with FALSEFLVG's business.

No ownership interest in FALSEFLVG Content is transferred to you merely because you access the Site or purchase a Product or Service.

Except for ordinary personal use expressly permitted by FALSEFLVG, you may not without prior written authorization:

  • copy;

  • reproduce;

  • republish;

  • redistribute;

  • sell;

  • license;

  • modify;

  • create commercial derivative works from;

  • scrape;

  • systematically extract;

  • publicly display for commercial purposes; or

  • otherwise commercially exploit

FALSEFLVG Content.

You may ordinarily share links to publicly available FALSEFLVG webpages.

Automated Scraping and AI Use

Except where required by law or expressly authorized in writing, you may not use:

  • bots;

  • crawlers;

  • scrapers;

  • automated extraction tools;

  • data-mining systems; or

  • similar automated processes

to systematically collect FALSEFLVG Content for:

  • commercial datasets;

  • unauthorized republication;

  • competing Products;

  • competing businesses;

  • model training;

  • artificial-intelligence training;

  • machine-learning training; or

  • other commercial exploitation.

Third-party names, trademarks, and intellectual property appearing through FALSEFLVG remain the property of their respective owners.

14. ACCEPTABLE USE

You may not use the Site, Products, Services, or FALSEFLVG systems to:

  • violate applicable law;

  • commit fraud;

  • impersonate another person;

  • interfere with Site security;

  • introduce malicious software;

  • gain unauthorized access;

  • harvest personal information;

  • transmit spam through FALSEFLVG systems;

  • scrape or systematically copy Site content contrary to these Terms;

  • interfere with another person's use of the Site;

  • infringe intellectual-property rights;

FALSEFLVG may investigate suspected violations and take lawful protective action.

The inclusion of a third-party provider within the definition of FALSEFLVG Parties does not make FALSEFLVG responsible for that provider's independent acts, omissions, systems, policies, or services to the extent those matters are outside FALSEFLVG's control, except where applicable law provides otherwise.

17. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR EXPRESS RIGHTS SPECIFICALLY PROVIDED IN WRITING OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED, THE SITE, PRODUCTS, SERVICES, DIGITAL MATERIALS, FALSEFLVG CONTENT, AND OTHER MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FALSEFLVG AND THE FALSEFLVG PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF:

  • MERCHANTABILITY;

  • FITNESS FOR A PARTICULAR PURPOSE;

  • NON-INFRINGEMENT;

  • TITLE; and

  • WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

FALSEFLVG and the FALSEFLVG Parties do not warrant that:

  • the Site will always be available;

  • the Site will always be uninterrupted;

  • the Site will be error-free;

  • every statement on the Site will always be complete or current;

  • a Product will be appropriate for every person; or

  • a Product will produce a particular health, cognitive, physiological, emotional, athletic, performance, or other result.

No oral or written communication creates a Product warranty unless FALSEFLVG expressly identifies it as such.

The 365-Day First-Purchase Guarantee is governed exclusively by Section 8 and does not create an additional Product warranty.

Some jurisdictions do not permit certain warranty exclusions.

In those jurisdictions, these exclusions apply only to the maximum extent permitted by applicable law.

18. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FALSEFLVG AND THE FALSEFLVG PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF BUSINESS OPPORTUNITY, OR SIMILAR DAMAGES ARISING OUT OF OR RELATED TO THE SITE, PRODUCTS, SERVICES, DIGITAL MATERIALS, FALSEFLVG CONTENT, THESE TERMS, OR YOUR DEALINGS WITH FALSEFLVG OR ANY FALSEFLVG PARTY, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

To the fullest extent permitted by applicable law, the aggregate liability of FALSEFLVG and the FALSEFLVG Parties for all claims arising out of or relating to:

  • the Site;

  • Products;

  • Services;

  • Digital Materials;

  • these Terms; or

  • your relationship with FALSEFLVG

will not exceed the greater of:

  1. the amount you actually paid directly to FALSEFLVG during the twelve (12) months immediately preceding the event giving rise to the claim; or

  2. one hundred U.S. dollars ($100).

These limitations apply regardless of the legal theory asserted, including:

  • contract;

  • tort;

  • negligence;

  • strict liability;

  • statute; or

  • otherwise,

to the fullest extent permitted by law.

Nothing in these Terms excludes or limits liability that applicable law does not permit to be excluded or limited.

Some jurisdictions do not permit particular liability limitations.

Where prohibited, the limitation applies only to the maximum extent allowed by law.

19. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless FALSEFLVG and the FALSEFLVG Parties from and against third-party:

  • claims;

  • demands;

  • causes of action;

  • liabilities;

  • damages;

  • judgments;

  • losses;

  • costs; and

  • reasonable attorneys' fees

arising out of or relating to:

  • Your Content;

  • your unlawful conduct;

  • your misuse of the Site;

  • your misuse of Products or Services;

  • unauthorized resale or redistribution;

  • infringement of another person's rights;

  • violation of these Terms; or

  • violation of applicable law.

FALSEFLVG may assume control of the defense of a matter subject to indemnification where appropriate.

You agree to provide reasonable cooperation.

This Section does not require indemnification to the extent prohibited by applicable law.

20. DISPUTE RESOLUTION, BINDING ARBITRATION, CLASS ACTION WAIVER, AND JURY WAIVER

PLEASE READ THIS SECTION CAREFULLY.

Except for matters expressly excluded below, this Section requires disputes to be resolved through binding individual arbitration rather than before a judge or jury in court.

A. Informal Dispute Resolution

Before commencing arbitration or litigation, the party asserting a dispute must send written notice describing:

  • the person's name;

  • contact information;

  • order or account information, if applicable;

  • the nature of the dispute;

  • the relevant facts; and

  • the relief requested.

LEGAL DISPUTE NOTICE

FALSEFLVG may send notice to the email or mailing address associated with your account or order.

The parties agree to make a good-faith effort to resolve the dispute for 60 days after receipt of a complete notice before initiating arbitration or litigation.

Any applicable limitations period will be tolled during that 60-day period to the extent required or permitted by law.

B. Agreement to Individual Arbitration

If the dispute is not resolved through the informal process, you and FALSEFLVG agree that any dispute, claim, or controversy arising out of or relating to:

  • these Terms;

  • the Site;

  • a Product;

  • a Service;

  • Digital Materials;

  • an order;

  • a promotion;

  • advertising;

  • communications;

  • customer service; or

  • the relationship between you and FALSEFLVG

will be resolved through binding individual arbitration except where expressly excluded in this Section.

Arbitration will be administered by the American Arbitration Association ("AAA") under applicable Consumer Arbitration Rules in effect when the arbitration is commenced, except to the extent those rules conflict with an enforceable provision of these Terms.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

The arbitrator may award individual relief available under applicable law subject to lawful limitations contained in these Terms.

C. Rights of FALSEFLVG Parties

To the fullest extent permitted by law, the arbitration agreement, class-action waiver, jury-trial waiver, defenses, limitations, and protections contained in this Section may also be invoked and enforced by a FALSEFLVG Party when a claim against that party arises from or relates to:

  • its work for FALSEFLVG;

  • its relationship with FALSEFLVG;

  • the Site;

  • a Product;

  • a Service;

  • fulfillment;

  • manufacturing;

  • advertising;

  • marketing;

  • an order;

  • customer communications; or

  • these Terms.

Nothing in this subsection independently makes every FALSEFLVG Party a contracting seller of Products.

D. Small Claims Court

Either party may bring an individual claim in an appropriate small claims court if the claim qualifies and remains solely within that court.

E. Intellectual Property and Security Matters

FALSEFLVG may seek temporary, preliminary, or other appropriate injunctive or equitable relief in court regarding actual or threatened:

  • intellectual-property infringement;

  • unauthorized system access;

  • malicious interference with Site security;

  • theft of confidential information; or

  • misuse of proprietary information

where such relief is legally available.

F. Arbitration Location and Format

Consumer arbitration may occur through:

  • written submissions;

  • telephone;

  • video conference; or

  • an in-person hearing in the consumer's county of residence

as permitted by applicable AAA rules and law.

G. Arbitration Fees

Arbitration fees will be allocated according to applicable AAA Consumer Arbitration Rules and applicable law.

Nothing in these Terms requires a consumer to pay arbitration costs that applicable law or binding arbitration rules require FALSEFLVG to pay.

Each party will otherwise bear its own attorneys' fees unless:

  • applicable law;

  • an enforceable agreement; or

  • the arbitrator

provides otherwise.

H. NO CLASS OR REPRESENTATIVE ACTIONS

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FALSEFLVG AGREE THAT EACH MAY ASSERT CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE PROCEEDING.

Unless both sides agree otherwise in writing, an arbitrator may not:

  • consolidate claims belonging to different individuals; or

  • preside over a class or representative proceeding.

If applicable law prohibits waiver of a particular form of public injunctive or representative relief, that claim will be handled as required by law and the remainder of this Section will remain enforceable to the fullest extent permitted.

I. JURY TRIAL WAIVER

FOR ANY DISPUTE THAT LAWFULLY PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND FALSEFLVG EACH WAIVE THE RIGHT TO A TRIAL BY JURY TO THE FULLEST EXTENT PERMITTED BY LAW.

J. Arbitration Opt-Out

You may opt out of this arbitration agreement by emailing:

with the subject:

ARBITRATION OPT-OUT

within 30 days after the earlier of your first purchase from FALSEFLVG or creation of a FALSEFLVG customer account after these Terms become applicable to you.

Your notice must include:

  • your full name;

  • the email address associated with your order or account; and

  • your order number, if available.

An effective opt-out applies only to the arbitration-related provisions subject to lawful opt-out.

The remainder of these Terms remains in effect.

K. Time to Bring Claims

To the fullest extent permitted by applicable law, any claim arising out of or relating to:

  • these Terms;

  • the Site;

  • Products;

  • Services; or

  • the relationship between you and FALSEFLVG

must be commenced within one year after the claim accrued, unless applicable law prohibits shortening the otherwise applicable limitations period.

Any required informal-resolution period will not count against that period to the extent required by law.

21. GOVERNING LAW AND COURT VENUE

These Terms and disputes involving FALSEFLVG are governed by the laws of the State of Indiana and applicable federal law, without regard to conflict-of-law principles, except where another jurisdiction provides a consumer right that cannot lawfully be waived.

For disputes not required to be arbitrated, the parties consent, to the fullest extent permitted by law, to jurisdiction and venue in the appropriate state or federal courts serving St. Joseph County, Indiana.

Nothing in this Section eliminates a non-waivable consumer right.

22. PRIVACY

FALSEFLVG's collection, use, storage, disclosure, and handling of personal information is described in the FALSEFLVG Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

Where a legally required privacy disclosure conflicts with these Terms concerning handling of personal information, the applicable legally required privacy disclosure controls with respect to that subject.

23. SUSPENSION, REFUSAL OF SERVICE, AND TERMINATION

To the extent permitted by law, FALSEFLVG may:

  • suspend Site access;

  • close an account;

  • restrict an account;

  • refuse an order;

  • cancel an order;

  • limit transactions; or

  • refuse future business

where FALSEFLVG reasonably believes a person has:

  • violated these Terms;

  • engaged in fraud;

  • abused a promotion;

  • abused the guarantee;

  • threatened Site security;

  • engaged in unauthorized resale;

  • infringed intellectual property;

  • harassed employees or contractors;

  • provided fraudulent information; or

  • engaged in other unlawful or harmful conduct.

Termination does not eliminate obligations, rights, defenses, or protections that by their nature should survive termination.

Surviving provisions include rights and protections belonging to FALSEFLVG and the FALSEFLVG Parties concerning:

  • intellectual property;

  • payment obligations;

  • content licenses;

  • disclaimers;

  • warranty limitations;

  • limitations of liability;

  • indemnification;

  • arbitration;

  • dispute resolution; and

  • other provisions that reasonably should survive.

24. CHANGES TO THESE TERMS

FALSEFLVG may update these Terms from time to time.

The "Last Updated" date at the top identifies the most recent version.

Changes generally apply prospectively.

Where required by applicable law, FALSEFLVG may provide additional notice regarding material changes.

Changes will not retroactively alter material terms of a completed purchase where applicable law prohibits doing so.

Your continued use of the Site after revised Terms become effective constitutes acceptance where such acceptance is legally sufficient.

Where affirmative consent is legally required, FALSEFLVG may request such consent.

25. FORCE MAJEURE

To the fullest extent permitted by law, FALSEFLVG and the FALSEFLVG Parties are not responsible for delay or failure caused by circumstances beyond their reasonable control, including:

  • acts of God;

  • severe weather;

  • natural disasters;

  • fire;

  • flood;

  • war;

  • terrorism;

  • civil disturbance;

  • government action;

  • epidemic;

  • pandemic;

  • embargo;

  • labor dispute;

  • carrier interruption;

  • utility interruption;

  • widespread internet outage;

  • supplier interruption;

  • manufacturing interruption;

  • material shortage;

  • transportation disruption;

  • cyberattack not caused by failure to exercise legally required care; or

  • other comparable circumstances beyond reasonable control.

This Section does not eliminate a cancellation, shipment, refund, or other right that applicable law requires despite such event.

26. SEVERABILITY

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary.

The remaining Terms will remain in effect unless applicable law requires otherwise.

27. NO WAIVER

FALSEFLVG's failure to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or another provision later.

Any waiver by FALSEFLVG must be expressly made by an authorized representative.

28. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without prior written consent from FALSEFLVG.

Subject to applicable law, FALSEFLVG may assign or transfer these Terms or its rights and obligations in connection with:

  • a merger;

  • acquisition;

  • financing;

  • corporate restructuring;

  • sale of assets;

  • change of control;

  • business transfer; or

  • similar transaction.

29. NO THIRD-PARTY BENEFICIARIES EXCEPT FALSEFLVG PARTIES

Except for FALSEFLVG Parties expressly granted rights, protections, defenses, licenses, releases, indemnification, or enforcement rights under these Terms, these Terms are not intended to create enforceable rights in unrelated third parties.

FALSEFLVG Parties may enforce provisions expressly intended for their protection to the fullest extent permitted by applicable law.

30. ENTIRE AGREEMENT

These Terms, the FALSEFLVG Privacy Policy, applicable Product-specific terms, and terms expressly presented with a particular offer constitute the agreement governing the applicable relationship between you and FALSEFLVG.

They supersede prior or contemporaneous communications regarding the same subject matter, except for separate written agreements executed by authorized parties.
