We offer the Website, including all information, opportunities, tools, products and services available from the Website (the "Services") to you, the user, conditioned upon your acceptance of all policies, terms, conditions, and notices stated herein. An offensive communication includes any communication sent, posted, or authorized by you, including without limitation postings on any website, social media account, or blog operated by you, which are: sexually explicit, obscene, vulgar, or pornographic; offensive, profane, hateful, threatening, harmful, defamatory, libelous, harassing, or discriminatory; graphically violent; solicitous of unlawful behavior; or that violates the intellectual property rights of another.

Reproduction of Website Content. Unless specifically permitted herein, no information, materials, files, videos, or other content (collectively "Content") comprising, contained in, or distributed through the Website may be reproduced in any form or used by you without the prior written consent of FalseFlvg. 1. Website Use

1.1 The Website is intended for the educational benefit of adults. If you use the Website, you are affirming that you are at least eighteen (18) years old or the legal age of majority in your state or province of residence (whichever is greater), have the legal capacity to enter into a binding contract with us, and have read these Terms and understand and agree to its policies, terms, conditions, and notices.

2. Dietary Supplements and Health Disclaimer

NEWBRAIN is a dietary supplement, not a drug. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Nothing on the Website is medical advice, and no content on the Website is a substitute for consultation with a qualified healthcare provider. Consult your physician before beginning any supplement, and particularly if you are pregnant or nursing, under the age of 18, taking prescription or over-the-counter medication, scheduled for surgery, or managing any medical condition. Discontinue use immediately and seek medical attention if you experience an adverse reaction.

Any description of benefits, ingredient research, or customer experience on the Website reflects general research or the experience of specific individuals and is not a promise or guarantee of any particular outcome for you. You are solely responsible for how you use our products, including adherence to the label directions and serving size.

Our products are intended for use by healthy adults 18 years of age and older, and are sold for personal use only. Ingredient research linked from the Website is provided for transparency and education, and citation of a study does not imply that NEWBRAIN produces the results reported in that study.

3. Account and Purchases

To make a purchase, you may need to provide personal information including your name, email address, payment information, and shipping address. You agree to provide accurate and complete information. All purchases are processed through third-party platforms such as Shopify, Shop Pay, PayPal, Venmo, Sezzle, etc. We are not responsible for errors or breaches that occur on those third-party platforms.

4. Product Information, Pricing, and Availability

We work to present product descriptions, ingredient amounts, imagery, labels, and pricing accurately, but we do not warrant that every detail on the Website is current, complete, or error free. Product labels and formulations may change, and you should read the label on the product you receive before use. We may correct errors, change prices, limit quantities per order or per customer, refuse or cancel any order, and discontinue any product at any time without notice. If we cancel an order because of a pricing, inventory, or availability error, we will notify you and issue a full refund of any amount charged.

5. Shipping and Delivery

Shipping timeframes shown on the Website are estimates and not guarantees. Title and risk of loss pass to you when the carrier takes possession of your package. We are not responsible for carrier delays, incorrect addresses supplied by you, or packages that a carrier records as delivered but that are reported missing or stolen. If a delivery problem occurs, contact us and we will make reasonable efforts to help you resolve it with the carrier. You are responsible for any customs duties, import taxes, or fees on shipments outside the United States.

6. 365-Day First Order Guarantee, Returns, and Refunds

If you do not feel a noticeable benefit from NEWBRAIN, your first order is backed for 365 days from the date of purchase. To request a refund, contact support@falseflvg.com with your order number. The following terms apply:

• The guarantee applies to first-time buyers and first orders only. Orders placed after your first order are not eligible.
• One refund per customer or household, on the first order only.
• The refund is capped at a maximum of three (3) tubs of NEWBRAIN, regardless of order size.
• No return shipment is required unless we specifically request it.
• Refunds are issued to the original payment method and may take several business days to appear.
• Original shipping charges, where applicable, are not refundable.
• We may decline or reverse a request that shows evidence of abuse, resale, or repeat claims across accounts, names, addresses, or payment methods.

For reasons of consumer safety, we cannot accept the return of opened or used product for resale, and returned product is discarded.

7. Email and Text Messages

If you provide your email address or mobile number, you agree that we may send you messages about your order and, where you have opted in, product news, ingredient research, and promotional offers. Message frequency varies. Message and data rates may apply to text messages. You may unsubscribe from marketing email using the link in any message, or reply STOP to opt out of texts. We will continue to send transactional messages relating to orders you place.

8. Intellectual Property

All content and materials on the Site, including text, graphics, logos, and images, are owned, licensed, or royalty free by FalseFlvg and are protected by intellectual property laws. You may not use, reproduce, or distribute any part of the Services without our express written permission.

9. Disclaimer of Warranties

Without limiting the foregoing, we make no warranty that any product will produce a specific health, cognitive, athletic, or performance result for you, and we disclaim all liability for outcomes arising from use of our products contrary to the label directions or without consulting a healthcare provider where these Terms recommend doing so. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law.

In no event shall FalseFlvg, its affiliates, its managers, or its employees be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim shall not exceed the amount paid by you for the Services in the preceding 12 months.

Our website may contain links to third-party websites or services (e.g., Klaviyo, Meta, Google Analytics, CookieYes). These links are provided for your convenience. We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites.

As used in these Terms, "Force Majeure Event" shall mean: any act of God, act of nature or the elements, terrorism, insurrection, revolution or civil strife, piracy, civil war or hostile action, labor strikes, acts of public enemies, federal or state laws, rules and regulations of any governmental authorities having jurisdiction over the premises, inability to procure material, equipment, or necessary labor in the open market, acute and unusual labor, material, or equipment shortages, or any other causes beyond the control of FalseFlvg. Delays due to any of the above causes shall not be deemed to be a breach of or failure to perform under these Terms. FalseFlvg shall not be required against its will to adjust any labor or other similar dispute except in accordance with applicable law.

FalseFlvg is pleased to hear from users and customers and welcomes your comments regarding our Services. FalseFlvg may use testimonials and/or product reviews in whole or in part together with the name, city, and state of the person submitting it. Testimonials may be used for any form of activity relating to FalseFlvg's Services, in printed and online media, as FalseFlvg determines in its sole and exclusive discretion. Testimonials represent the unique experience of the participants and businesses submitting the testimonial, and do not necessarily reflect the experience that you and your business may have using our Services. As set forth above in these Terms, your individual results will vary depending upon a variety of factors unique to your health and forces beyond FalseFlvg's control. Anything that you or your business submit or post to the Website and/or provide us through email, forms, surveys, comments or any other medium, or post on any social media or other websites about us, including without limitation, photographs, testimonials, ideas, know-how, techniques, questions, reviews, biographies, your name, comments, and suggestions is and will be treated as non-confidential and non-proprietary, and we shall have the royalty-free, worldwide, perpetual, irrevocable, and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, and create derivative works from such submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or decompile such submissions. You agree that this authorization and license may be assigned by FalseFlvg to any other party. Additionally, FalseFlvg reserves the right to correct grammatical and typing errors, to shorten submissions prior to publication or use, and to review all submissions prior to publication or use. FalseFlvg shall be under no obligation to use the whole of, or any part of, any submission.
